Terms of Service

These Terms of Service ("Terms") govern your use of TradeDesk at tradedesk.now (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TradeDesk is a reference and productivity tool for licensed plumbers and gas fitters in Australia and New Zealand. It provides searchable summaries of standards, calculators, document templates, lodgement helpers (Form 7, Form 9, inspection bookings), an AI assistant, a jobs board and related features.

2. Not professional advice

The Service is a reference tool — not a substitute for professional judgement. Every output, including AI-generated answers, calculator results, document drafts and standards summaries, must be reviewed by an appropriately licensed plumber or gas fitter before it is acted on or submitted to any authority. You remain responsible for compliance with all applicable laws, regulations and standards (including AS/NZS 3500, AS/NZS 5601, the Plumbing and Drainage Act 2018 (Qld) and equivalents in other jurisdictions).

3. Eligibility and account

  • You must be at least 18 years old.
  • You must hold the licences required to perform plumbing or gas-fitting work that you record using the Service.
  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • You must provide accurate, current information (business name, ABN, licence number, contact details).

4. Acceptable use

You agree not to:

  • Use the Service to break the law or to lodge false or misleading documents with any authority.
  • Reverse-engineer, scrape or interfere with the Service or its infrastructure.
  • Use the Service to send spam, harassment, or to defame any other user.
  • Resell or redistribute Service content without permission.
  • Upload malware, illegal content, or content that infringes another person's rights.

5. Standards content

Where the Service displays summaries, paraphrases or extracts of Australian Standards, New Zealand Standards or joint AS/NZS Standards, those summaries are provided for navigation and convenience only. The Standards themselves remain the property of the relevant standards bodies. Always consult an authoritative copy of any Standard before relying on it.

6. Lodgement on your behalf

When you instruct the Service to email a Form 7, Form 9, or inspection booking to a council, you authorise us to send that email using the contact details you supplied. You remain responsible for the accuracy of the information sent and for any follow-up the council requires. The Service does not guarantee delivery, acceptance or processing by any council.

7. Subscriptions and payments

Some features may be offered free of charge while others may require a paid subscription or one-off purchase. Pricing, features and billing terms for paid plans will be presented at the point of purchase. Where pricing changes apply to existing customers, we will give reasonable advance notice.

8. Intellectual property

We retain all rights in the Service, including its software, design, AI prompts and templates. You retain ownership of the content you create or upload. By using the Service you grant us a non-exclusive licence to host, display and process your content as needed to provide the Service to you.

9. Warranties and liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without any express or implied warranty as to fitness for a particular purpose, accuracy of standards content, or uninterrupted operation. Nothing in these Terms excludes any guarantee, warranty or right that cannot be excluded under the Australian Consumer Law.

Subject to the previous paragraph, our total aggregate liability arising from or related to your use of the Service is capped at the greater of (a) the fees you paid us in the 12 months immediately preceding the claim, or (b) AUD $100.

10. Termination

You may stop using and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that exposes us or other users to risk.

11. Privacy

Your use of the Service is also governed by our Privacy Policy.

12. Changes to the Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect any changes. Continued use of the Service after a change constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of Queensland, Australia. The courts of Queensland have exclusive jurisdiction over any dispute arising from or related to these Terms or the Service.
